Terms and Conditions

These Terms and Conditions govern your use of the Build With You Pools website, estimator, forms, consultation tools, videos, and related online services.

Important Construction Contract Notice

The website, online estimator, consultations, videos, and preliminary project discussions do not create a swimming pool construction contract. Any construction work requires a separate written agreement identifying the licensed contracting party, applicable Arizona Registrar of Contractors license number, project scope, price, payment terms, permits, warranties, schedule, and other legally required terms.

1. Acceptance of These Terms

By accessing or using the Build With You Pools website, online estimator, consultation forms, video library, appointment tools, or related services, you agree to these Terms and Conditions and our Privacy Policy.

If you do not agree, do not use the website or submit information through its forms or tools. You must be at least 18 years old and legally able to enter agreements to submit a project request or schedule a consultation.

2. Website Purpose

The website provides general information about pool planning, preliminary pricing, design options, the Build With You Pools program, contractor coordination, consultations, project examples, service areas, and related backyard services.

Website content is provided for general informational and planning purposes. It is not architectural, engineering, legal, financial, tax, insurance, safety, or professional construction advice.

Project photographs, videos, renderings, illustrations, plans, material samples, and descriptions are examples only. Actual designs, finishes, dimensions, colors, equipment, landscape conditions, and completed results vary by property and project.

3. Online Estimates, Pricing, and Potential Savings

Preliminary estimates

Any estimate generated through the website is a preliminary planning range based on the information and selections entered by the user. It is not a bid, guaranteed price, construction proposal, or offer to perform work.

Actual pricing may change after property review, measurements, design development, engineering, access evaluation, permits, utilities, soil or rock conditions, demolition, HOA requirements, contractor pricing, equipment, materials, labor, taxes, fees, and final scope.

Savings statements

References to helping homeowners save $20,000 or more describe the program’s goal and potential outcome compared with certain traditional pool-builder pricing models. Savings are not guaranteed. Actual savings vary by project, market conditions, contractor pricing, selected materials, scope, location, and the proposal used for comparison.

Do not rely on an online estimate as a final construction price. Final pricing must be stated in a separate written agreement signed by the appropriate parties.

4. Construction Services and Written Agreements

Use of the website does not hire Build With You Pools, Atmosphere Pools & Landscape, or any contractor to perform construction. No contractor-client relationship begins until the required parties enter a separate written agreement.

The written agreement controls the actual project and should identify, as applicable:

  • The legal contracting party and applicable Arizona ROC license number.
  • The property, project description, plans, specifications, and included work.
  • The total price, allowances, payment schedule, and change-order process.
  • Responsibility for permits, engineering, HOA review, inspections, utilities, access, and site preparation.
  • Estimated schedule, delays, material availability, and owner responsibilities.
  • Product, equipment, workmanship, and manufacturer warranty terms.
  • Cancellation, suspension, default, dispute, and termination provisions.

If these Terms conflict with a signed project agreement, the signed project agreement controls the construction project.

5. Contractors, Vendors, Financing, and Other Professionals

Project planning may involve licensed contractors, subcontractors, designers, engineers, suppliers, lenders, financing providers, manufacturers, inspectors, municipalities, HOAs, and other independent parties.

Unless a written agreement expressly states otherwise, independent contractors and third-party providers are responsible for their own work, licensing, insurance, pricing, schedules, warranties, approvals, and legal compliance.

Financing information is provided for convenience only. Financing is subject to lender approval, credit requirements, rates, terms, fees, and separate lender agreements. Build With You Pools does not guarantee financing approval or loan terms.

Product and equipment warranties are provided by the applicable manufacturer, supplier, installer, or contracting party according to their written warranty terms.

6. Information You Provide

You agree that information submitted through the website is accurate, current, and complete to the best of your knowledge. This includes contact information, property address, project details, budget, photos, access conditions, HOA information, and estimator selections.

You represent that you have permission to submit any photos, plans, files, documents, or other materials you provide. You grant us a nonexclusive license to use submitted materials as reasonably necessary to review your request, prepare estimates, coordinate consultations, and support the requested project.

You are responsible for confirming property ownership, legal authority to approve work, easements, utilities, property lines, HOA requirements, and other property-specific restrictions.

7. Electronic Communications, Telephone Calls, and Text Messages

By submitting a form or requesting a consultation, you consent to receive electronic communications about your request, estimate, appointment, project, and related services using the contact information you provide.

When you separately consent to text messages, message frequency may vary and message and data rates may apply. Consent to marketing messages is not a condition of purchasing services. Reply STOP to opt out of text messages or HELP for assistance.

You agree that electronic records, notices, confirmations, and signatures may be used where permitted by applicable law. You are responsible for maintaining a valid email address and telephone number.

8. Acceptable Use

You may not:

  • Use the website for unlawful, fraudulent, misleading, abusive, or harmful purposes.
  • Submit false information, impersonate another person, or misrepresent authority over a property.
  • Attempt to gain unauthorized access to the website, servers, forms, CRM, estimator, or related systems.
  • Introduce malware, malicious code, automated scraping, excessive requests, or other technology that disrupts the website.
  • Copy, republish, sell, reverse engineer, or commercially exploit website content or estimator logic without written permission.
  • Use project images, plans, text, videos, logos, or designs in a way that infringes intellectual property or privacy rights.

9. Intellectual Property

The website, branding, logos, text, videos, graphics, page designs, estimator content, software, and other original materials are owned by Build With You Pools, its affiliated companies, licensors, or content providers and are protected by applicable intellectual property laws.

You may view and use the website for personal project-planning purposes. No ownership rights are transferred to you. Written permission is required for commercial reuse, republication, modification, distribution, or creation of derivative works.

10. Third-Party Websites and Embedded Services

The website may link to or embed services operated by third parties, including video platforms, estimators, scheduling systems, maps, financing providers, social media platforms, analytics tools, and customer relationship management systems.

Third-party services are governed by their own terms and privacy policies. We are not responsible for their availability, content, security, accuracy, pricing, products, services, or conduct.

11. Website Availability and Changes

We may update, suspend, restrict, or discontinue any part of the website without notice. We do not guarantee uninterrupted availability, error-free operation, compatibility with every device, or that all information will remain current.

Service areas, program details, features, pricing tools, contractors, financing options, videos, and website content may change.

12. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the website and online tools are provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, completeness, merchantability, fitness for a particular purpose, or noninfringement.

To the maximum extent permitted by law, Build With You Pools and its owners, affiliates, employees, agents, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from website use, inability to use the website, reliance on preliminary estimates, third-party services, or unauthorized access to submitted information.

Nothing in these Terms excludes liability that cannot legally be excluded. Construction-related rights, remedies, warranties, and liabilities are controlled by applicable law and the separate written project agreement.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Build With You Pools and its owners, affiliates, employees, agents, licensors, and service providers from claims, damages, liabilities, costs, and expenses arising from your misuse of the website, violation of these Terms, submission of materials without permission, or infringement of another person’s rights.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Unless a separate written agreement requires another process or venue, disputes relating solely to these website Terms will be brought in a court of competent jurisdiction in Maricopa County, Arizona.

These website Terms do not replace any dispute, notice, warranty, complaint, mediation, arbitration, or litigation procedures contained in a signed construction or service agreement.

15. Changes to These Terms

We may revise these Terms to reflect changes in the website, services, business practices, or legal requirements. The updated version will be posted on this page with a revised effective date. Continued use of the website after an update means you accept the revised Terms.

16. General Provisions

If any provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms and the Privacy Policy form the agreement governing use of the website, but do not replace a signed estimate, design, construction, financing, or service agreement.
